' ,' Gustavo Nelson and Michael' Connolly, who had been convicted of drunkonneSs once : previously, were convicted and fined 10s. each, in default 48 hours', imprisonment. .-'y INCITING TO RESIST. ; , George BoWdon admitted having, on January 2, incited, William Briskcl to resist Coristablo .M'Lcod in tho execution.of his duty on the Queen's Wharf, and also having used obsceno. language. .Sub-Inspector O'Donovan informed the Court that accused belonged to tho Athenic, and that tho offences wero committed whilst Constable M'Lcod was arresting Briskel, a, companion .Of accused, for drunkenness;: Accused 'stated that ho was .undor tho influence of liquor at tho time;' ' On tho first oharge, accused was fined £5, in .dofsiulfc ono month' 6 imprisonment; and, on the' second charge,'£2 with costs,, in dofault' 14 (lays', imprisonment.' ... V BREAKING A SHOP WINDOW. ■ Joseph ■ John Hagerty pleaded not guilty .to tt charge Of having, on December 26, wilfully broken a pano of glass valued at £7, •tho property of Gallate 8r05.,-Cuba Street. George' 11. Gallato gavo evidence that,-on Boxing Day, had a meal at his restaurant, but at, first disputed payment, .alleging that lie had already paicl for' 1 tho meal. :At tho time he was . under tho influence of liquor. Witness ordered him out because ho .used bad As accused was . leaving, ho said: r<i l'll fix. you." Then he broko .the window with-hi3 shoulder. . .

Constable Lister deposed that lie caught sight of accused immediately after the window was broken. Accused ran down tho street. , ' » Accused admitted having'' had a dispute regarding' the' payment of tho meal, but contended that:ho accidentally fell through the u v indow. " ' ,
His Worship fined accused £3 ,with costs, and ordored him to pay tho amount of. the damago, in dofault 21. days' imprisonment. Fourteen days in which to pay was. allowed.
