A PAINFUL CASE.

An unusually painful caso was before tha Magistrate; at the '-Police; Court;';'- Richard Henwood was charged with cruelly ill-treating, and torturing a* greyhound owned'by >Th6mas Honry Coghlan, by< smashing a shoulder and jaw, and dislodging ah eye, and' with - failing to- terminate its sufferings. - '-Honwood, was further charged, with . assaulting .-Arthur Neville by. pointing''at; niin a double-barrelled gun, and threatening to shoot him,-and,also with using ' obsyone; language in Mangero.Mr. Lundon! prosecuted on behalfr of t iil?., Neville, and Mr. Sharpies appcalred for defendant. The evidonoo for the prosecution was to the effect'that a coursing party was-passing Hen-, wood's place. at'Mangere, when a hare wad put up and the greyhound set off in pursuit. Kenwood came along,.and at lirst threatenedNovillc with a loaded gun, and round, and shot the. dog. .The dog .-was not killed outright, and Henwood rode oft, refusing t6 put an end'to its sufferings. The men then went to Henwood's house, and asked: him why he did. not'kill the-dog:in-. 1 stead of leaving it there to suffer. Henwood: was alleged to have, then used the language complained of. ■ •''«• "j Defendant admitted that, he shot the dog as he had been annoyed by coursing parties and their dogs get-ting. amongst : the shcop. His reason for not putting an. end ..to t*ha dog's sufferings was) because lie did-.not-have,-a .second .cartridge. ' He denied'-threatening Neville with the gun or.haying.used'the-lan-guage. He thought .he had the right to shoot- the dog for trespassing. • ,'t . Mr.. Kettle, S.M., said it was his' opinionthat the act of shooting at the dog with; the' intention of killing it'.was not:cruelty.;. He had no doubt that thq'shot was.; illegal,' but in that- case-a-civil court' action'would ibe.the' : remedy. He- was quite satisfied that Hen-; wood. pointed the gun at.
