The opening of tho now bathhouse at Tarawera : by v the'• Tourist' Oopartmerit brings the curative properties of ; thc'thermal district within one and !a half day's journey from ' Wellington. The magnificent-' scenery ■ along ■ the routo makes the 'drive from Napier most interesting; The" new;' baths have been, erected under tho direction of : Dr. ■ . Wdhlmarin, Government Balncologist, and Mr. Alfred Warbnck, guide and inspector of tho Tourist Department' at Rotorua".' One large bath is ■ provided, and two smaller ones, one of the 'latter being for persons suffering from infectious diseases. On his return from./ the opening ceremony,Mr. J. Vigor Brown, Mayor of Napier", spoke in high, terms of tho accommodation and bathing facilities provided, which.he says, owing to their close proximity, should prove a valuable asset: to this town; •'■' : ' The Turakina was concerned in an action of' considerable interest to shipping 'circles, in which reserved judgment was given by Mr. Brabant, S.M. This was tho case; of; Louisa R. Elyey v the New Zealand ■ Shipping. Company. Plaintiff -claimed £60 damages for loss'of a box of [ luggage during tho voyage of the Turakina from London to Wellington, by which steamer she (then Miss Parkcs)..was a; passenger. The box was proved in evidence to contain presents given to plaintiff on her marriage,,which was then contemplated, and included a violin, which she ' was ' -bringing.'• but -to her intended ; husband; Tho Magistrate quoted the "conditions of the ticket issued to -plaintiff, which showed that the Company, were not liable for personal effects of 'passengers beyond £5, above'which'excess rates had to he paid. AH "questions arising on the contract ticket had, ho held, to bo decided according to' British law, by which tho contract was niade. • If- the case had to be decided by New Zealand ■law, probably tho defendant company .would not bo exempted from liability. By' the terms of plaintiff's ticket, he held that tho. Company could only be liable for £5 for loss of the box, and gave judgment for that amount, with costs. ... ..-':.. v
