Ereeman, t!ie defendant, was not present when the arrangement was made, but was represented by a man named Dalgleish. Freeman denied that Dalgleish (iii his behaif represented Up-to-Dalc to be sound. The defendant sold Dalmuir immediately after the exchange .was made. Mr Hay, for Freeman, said Up-10-Da'te was originally sold to one O'Neii, who combatted (hi' allegation of iiu.-oundness, and said Up-to-Date had taken fourth prize at the Dunedin horse parade, -17 competing.
