GOLD DUTY.
It saeriis likely enough, as has been sug-. gested, that an ordihace of ythe Provincial Government for repayment of the whole or .part of the gold duty collected in Otago, must be considered inva^d as> bi-ingrufrra'. vires t as an ordinance antagonistic i to an Act of "'the -'General. Assembly, : ; All pro-, vincial revenue is in fact only general revenue collected and administered by pro-' vincial authorities.. If an Act of the General Assembly has imposed'eertain taxes of duties, the Provincial Government; might be empowered to remit 'the gold duty, either by a direction" in such Act that on the passing of a provincial Ordinance to that effect, the; gold duty should hot be collected in < tago, or by: allowing the Pro-* vincial Government, to devote^a portion of the provincial revenue to. the repayment, of duty collected. ;' In the absencVdf 6uch permission from the General Assembly^ it seem? tolerably cliear the Provincial Council cannot remit the, duty, directly or indirectly. It is to be hoped, however, that before long this, obnoxious, and lUpj-ist gold duty will be abolished throughout Netr Zealand by an Act of the Geaeral Assam*bly. •>•-... ■
