Public Notices TASMAN DISTRICT COUNCIL NOTICE OF TASMAN DISTRICT COUNCIL PROHIBITING VEHICLES AND CONSUMPTION OR POSSESSION OF INTOXICATING LIQUOR IN PUBLIC PLACE THE Tasman District Council (hereinafter referred to as the Council) hereby gives notice that pursuant to Section 709 A of the Local Government Act 1974 it has resolved: (a) CLOSURE OF ROAD THAT during the holding of New Year’s Eve celebrations: 1. That part of the Ka-iteriteri-Rlwaka Road from the track at Breaker Bay to the Bridge at the approach to Kaiteriteri (hereinafter referred to as the specified road) will be closed to ordinary vehicular traffic during the period commencing 6.00 p.m. Sunday, December 31, 1989 to 3.00 a.m., Monday, January 1, 1990 (hereinafter referred to as the period of closure). 2. That the Breaker Bay Beach be subject to a prohibition of the consumption and possession of intoxicating liquor during the period of closure. (b) ACTS PROHIBITED IN SPECIFIED AREA (1) The drinking of intoxicating liquor in the specified road or place. (2) The bringing of intoxicating liquor or empty intoxicating liquor containers in the specified road or place. (3) The possession of intoxicating liquor or empty intoxicating liquor containers in the specified road or place. (4) The driving or riding of any motor vehicle in the specified road during the specified period other than the following vehicle; firefighting appliances, police and traffic • officers’ vehicles, ambulances and District Council vehicles. (c) EXEMPTIONS The resolution does not prohibit: The carrying of intoxicating liquor on to premises or land having a frontage on to the specified road, if the liquor is being carried by or for delivery to a person residing on those premises or his bona flnde visitors — provided the liquor is promptly removed from the road. The driving or riding of any motor vehicle from or to premises having a frontage to the specified road by a person residing in those premises or by his bona fide visitors./ 1 (d) POWERS OF THE POLICE A further effect of the resolution of the Council is that any constable may, without warrant: Arrest any person whom he finds committing an offence as 'mentioned herein; During he period of closure and prohibition, arrest any person whom he has reasonable cause to suspect of having committed such an offence; Search any parcel, package, bag, case or other container in the possession of any person in or entering or about to enter the specified road, or place during the period of closure and prohibition, for the purpose of ascertaining whether or not the parcel, package, bag, case or container contains any intoxicating liquor or any empty intoxicating liquor container, unless the person in possession of the parcel, package, bag, case or other container removes it from or, as the case may be, refrains from taking it into the specified road or place and leaves it outside the road or place until the period of closure and prohibition then applying has expired. Any constable may seize and remove any intoxicating liquor and any intoxicating liquor container which he has reasonable cause to believe would be evidence of committing such an offence. (e) DEFINITION In this notice: "Intoxicating liquor” means liquor as defined in the Sale of Liquor Act 1962.
