Plaintiffs AND NEW ZEALAND GUARDIAN TRUST COMPANY LIMITED a duly Incorported company having its registered office at Auckland and carrying on business throughout New Zealand as a Trustee Defendant NOTICE TO ALL PERSONS HAVING DEPOSITED MONEY WITH DINGWALL AND PAULGER LIMITED (IN RECEIVERSHIP) PURSUANT TO AN INTEREST EARNING DEPOSIT ACCOUNT SCHEME TAKE NOTICE that PETER GEORGE STEEL and TIMOTHY MICHAEL HERRICK (herlnafter referred to as “the Plaintiffs”) have made application to the High Court at Christchurch SEEKING ORDERS: (I) Declaring or determining that all deposits received by Dingwall and Paulger Limited (In Receivership) (hereafter referred to as “the Company”) pursuant to the Company’s Interest earning deposit account scheme are not secured under a Debenture Trust Deed executed by the Company in favour of the New Zealand Guardian Trust Company Limited on June 5 1984, or In any other matter. (II) Declaring or determining that all Individuals who deposited money with the Company under the Company’s Interest earning deposit account scheme (hereinafter referred to as “the depositors”) are unsecured creditors of the Company. AND FURTHER TAKE NOTICE THAT THE COURT HAS ORDERED THAT: (I) IThe New Zealand Guardian Trust Company Limited be appointed as the representative In the instant proceedings of the Interests of all the depositors. (II) Any depositor may, If desired, be individually represented in these proceedings.
