Tennis veteran loses appeal

PA Wellington An 81-year-old woman forced to give up tennis after breaking her wrist has lost an appeal for increased compensation. Mary Allsop, of Christchurch, broke her right wrist in January, 1987, after she was knocked down by a car while crossing a road. She was awarded $BOOO for pain, mental suffering, disfigurement and loss of enjoyment, which the Accident Compensation Appeal Authority has refused to increase.

Judge Middleton said the appellant submitted she had to give up playing tennis because her hand had lost power and grip. She had problems sewing and performing normal activities in the kitchen and garden. She submitted the award was too low because of the pain and suffering and the fact that she had to give up most of her pleasures. “She is also concerned at the permanent deformity in her hand and that she now has to use her left hand for most activities,” the Judge said. Nevertheless, he concluded the award of $BOOO was appropriate in this case.
