Union sued for $10M

PA Auckland The single biggest damages claim against a New Zealand trade union opened in the Labour Court at Auckland yesterday. Fletcher Challenge, Fletcher Construction, Fletcher Merchants and Firth Industries are suing the Labourers* Union and several of its officials for a total of $lO million. The claim relates to alleged unlawful industrial action taken by the union last year. The case was originally pursued by the companies in the High Court but after a union appeal, jurisdiction was given to the Labour Court. Counsel for the union, Mr Tim Castle, said the issue to be decided was whether the union action was lawful under the Labour Relations Act. He described the case as one of the most important hearings dealing with labour relations to come before the Court. He submitted the union’s action was lawful strike action under the act and was designed to aid the settlement of the labourers’ award. Proceeding.
