NZPA Sydney Legal preparations to hear damages claims over the sinking of the Soviet cruise ship Mikhail Lermontov made progress in the New South Wales Supreme Court yesterday. Lawyers representing about 150 Australian passengers suing for loss of luggage have sought documents since February from the legal representatives of the ship’s owner, Baltic Shipping Company and its charterer, C.T.C. Cruises. The court heard yesterday that documents from C.T.C. had been produced and others from Baltic Shipping Company in the Soviet Union were on their way to Sydney lawyers. The documents include plans of the Mikhail Lermontov, charts in use on

the bridge when it sank in Marlborough Sounds in February, 1986, copies of all radio, telex and other messages sent from the ship immediately after it was stranded and all correspondence and reports relating to the engagement and duties of Captain Don Jamison as pilot of the ship. Judge Kenneth Carruthers last week said he was concerned that the documents had not been “discovered” after 10 months and he directed that they be produced by Thursday. Yesterday he said he had not implied any criticism but wanted to ensure that the hearing proceeds on the date fixed next April. He stood the matter of the document discovery over until February 16 for further direction.
