Finding of disgraceful conduct upheld

PA Wellington The High Court has dismissed a former doctor’s application for a review of a Medical Council decision finding him guilty on four charges of disgraceful conduct including conducting unprofessional examinations of vaginas and breasts. In a judgment in the High Court at Wellington, the Chief Justice (Sir Ronald Davison), Mr Justice Chilwell and Mr Justice Greig dismissed Nihal Sydney Gurusinghe’s ap-

peal against the decision of the Medical Council of December 19, 1985. The council found him guilty on four charges of disgraceful conduct in a professional respect and ordered his name to be removed from the medical register. The court has also refused his application for a review of the decisions of the council and dismissed his application against $20,000 costs imposed by the council. Handing down the judgment, Sir Ronald said that

in the period March to July, 1985, letters of complaint were received by the Medical Council from six female patients of Gurusinghe’s concerning his conduct during the course of medical examinations. After investigation, the preliminary proceedings committee of the council preferred four charges of disgraceful conduct in a professional respect against Gurusinghe. The council found him guilty on all four charges.
