Court upholds jail sentence
PA Wellington A man who robbed a Blenheim dairy while armed with a softball bat has had his three-year prison sentence upheld. Gary Stephen Codlln appealed against the sentence for aggravated robbery imposed in the High Court at Blenheim. Codiin had pleaded guilty to the October, 1985, robbery, in which $240 was handed over by the dairy owner. Codiin performed the robbery with a cardigan tied round his head to serve as a disguise. Delivering the Court of Appeal’s decision, Mr Jus-
tice Bisson said the sentence was within the appropriate range. The sentencing judge took into account the less serious aspects of the case, the personal cifcumstances of Codlln and the need for a deterrent sentence. Counsel for Codlln submitted that Codlln’s judgment was impaired by drugs and alcohol and he behaved in a “grossly inept manner." Counsel for the Crown had said the element of intoxication created a danger of an error of judgment by the robber, Mr Justice Bisson said in the decision.
