San Diego site —club

PA San Diego San Diego would be the site of the America’s Cup regatta in 1991, the San Diego Yacht Club announced yesterday. However, it said the site and date was subject to the pending New York Supreme Court ruling on whether the club was required to accept a challenge from the Auckland banker, Mlcheal Fay, and the Mercury Bay Boating Club.

“If the court decides the San Diego Yacht Club/Sail America foundation must accept the challenge, all aspects of the match would be reconsidered,” said Gerald Driscoll, chairman of the San Diego America’s Cup committee. Basing his case on the actual words of the rules

governing the America’s Cup, Mr Fay has challenged San Diego to a cup series next year in San Diego using massive 90 foot waterline boats.

The expected San Diego announcement on the site and date for the next cup series was to have been made last week but was blocked by a temporary restraining order obtained by Mr Fay from the New York Court which oversees the America’s Cup. The temporary restraining order was lifted by the court on Wednesday, Justice Carmen Beauchamp Ciparick reserving judgment on the main issues of the case. Her decision is expected in a few weeks. The seven-man San Diego America’s Cup committee represented by Mr Driscoll has been

formed by the San Diego Yacht Club and Sail America Foundation, its commercial manager for running the cup. A statement issued at the press conference here said the committee was responsible for choosing the method Sail America would use to select the defender. It would also serve in a review and advisory capacity to the club and Sail America, it said. A total of 18 challengers have notified San Diego they want to try to win the cup in 1991.
