Consumers protected by new guarantee

To protect both the client and its members, the New Zealand Spa and Pool Association has just negotiated a performance guarantee insurance policy. This guarantees the workmanship of a “basic pool” and protects the consumer by underwriting the members’ performance during pool construction. The policy offers insurance cover for the duration of two years commencing from the completion date of the contract, with a 75 per cent limit of an indemnity of the basic contract price. This guarantee applies to all contracts drawn up on an official contract form. Because insurance cover of this type is only

available to members of the New Zealand Spa and Pool Association, leaders of the association urge consumers to think seriously before dealing with any pool retailers or equipment suppliers outside of the association. “There are a lot of ‘fly-by-nights’ in this line of work, so it’s for consumers’ own protection that they make sure their pool contractor won’t pull out of the job bankrupt while it’s still half complete,” said Mr Harry Sweeney, the South Island convenor for the Spa and Pool Association. “When dealing with one of the Spa and Pool members, consumers can remain secure in the knowledge that the association backs up all its members and, therefore, the job

will be completed,” he said. “The association is a means of keeping a competitive and professional standard up within the pool business,” Mr Sweeney said. Those planning to install a new spa or swimming pool are well advised to ask about the performance guarantee insurance policy at a local Spa and Pool Association member.
