Legal action not halted

A bid to drop legal action against the Government over its claim on Christchurch Airport assets was lost at the Christchurch City Council’s airport committee meeting yesterday.

The committee’s chairman, Cr Morgan Fahey, used his casting vote to defeat a move to have rescinded a council decision to seek costs incurred in its opposition to the Government bid to take $4.4 million of airport reserves.

The council opted last month to act to recoup costs after the Government withdrew its claim on the reserves.

Constable felt yesterday that the action was “vindictive” in view of the Government’s change of heart. A letter from the Minister of Civil Aviation, Mr Prebble, was tabled at yesterday’s meeting. It labels the council action as unnecessary and regrettable.

The three councillors sought a notice of motion passed to have the legal action halted. A 3-3 vote of the notice-of-motion re-i commendation was broken by Cr Fahey’s casting vote. Cr Fahey said that considerable expense had been incurred in initial court action to fight the Government’s claim.
