Ford damages appeal adjourned
PA Auckland An interim application by the Northern Storepersons’ Union for the setting aside of a $1.66 million damages claim against it was adjourned yesterday. April 15 was set down for the proceedings. The application was to have been heard by Mr Justice Chilwell in the High Court at Auckland. His Honour recently awarded the damages to the Ford Motor Company after a formal proof hearing. In asking for the adjournment, Mr Kenneth Johnston, for the company, said that not all of the affidavits mentioned «n the notice of‘)motion had been served. >0
The company needed time to prepare the necessary affidavits in response, he said.
‘ He believed the union would consent to the postponement on the basis that the company undertook not to execute the damages judgment until the interim motion was disposed of, and he said he was in a position to give such an assurance. Mr Noel Anderson, Q.C., for the union, said that in view of the company’s undertaking the union consented to the adjournment.
His Honour ruled that the damages judgment not be executed until jhe interim had been disposed of.
