National calls for C.E.R. court

PA Wellington A special court should be set up to deal with commercial disputes arising out of the closer economic relations agreement with Australia, said the Opposition spokesman on justice Mr Jim McLay. Calling for greater uniformity of trade and commercial laws between the two countries, he said one of the objectives of C.E.R. was to establish an integrated Australian and New Zealand market. “No market can be described as integrated or rationalised until there is uniformity between the rules that operate in both countries,” he told the Australasian Law Reform Agencies Conference at Parliament. A number of areas needed attention, including trade practice laws, food and drug laws, consumer protection and labelling, credit contracts, corporate law and mergers and takeovers. Mr McLay said it was important to avoid parties “shopping” for the legal jurisdiction they believed best suited their case. special commercial court, comprising both Australian and New Zealand judges, could resolve legal disputes arising from C.E.R.-inspired legislation.
