Mayor’s eligibility ‘up to the courts’

PA Auckland The Internal Affairs Department does not want to become involved in charges that the Mayor of Waitemata, Mr Tim Shadbolt, is ineligible to continue in office because he disqualified himself by not being on the latest Parliamentary electoral roll.

Waitemata City Council officers have sought advice from the department about the allegations. The department’s chief executive officer of local Government, Mr Brian Jackon, said yesterday

that Mr Shadbolt’s eligibility was now a matter for the courts to decide. “If they feel Mr Shadbolt is no longer qualified to hold office, they will have to seek an ouster of office or a declaratory judgment from the court,” he said. The city solicitors believed any person holding

public office who ceased to be an elector had to vacate office. Mr Shadbolt has now enrolled and has received legal advice that he is eligible to remain as Mayor.
