Kiwi Shipping ordered wound up
P Wellington The coastal freight ferry operator, Kiwi Shipping, was yesterday ordered to be wound up. The order was granted by Mr Justice Ongley in the High Court in Wellington on the application of several creditors including the company’s operations manager, Peter White.
Kiwi Shipping brought a 1117-ton freight ferry to New Zealand earlier this year, naming her Kiwi. But before the vessel could begin trading on her planned east coast four-port run, the
rival Pacifica Shipping succeeded in winning a High Court injunction effectively preventing the firm operating for several months. This injunction expired on October 1.
Three counsel representing five creditors, claiming a total of $18,544, appeared in court yesterday but nobody from Kiwi Shipping appeared to give evidcncc. < Mr White told the Court he was owed at least $2871 in wages when the court Kwere filled, but this w increased to about $4BOO.
His Honour ordered the company wound up, and payment of $250 costs to Mr White, plus $3O costs to the other creditors. Mr White’s counsel, Mr Nigel Hughes, also represented Wellington Provedoring Service, and Capital Fire Extinguishers. He said outside the court they were owed $7223 and $1266 respectively. The other creditors, Allfloor Services and William Cable, claimed Kiwi Shipping owed them $762 and $6422 respectively. The Kiwi is now tied up at Wellington’s overseas passenger terminal, where she was moved after creditors successfully applied for a High Court arrest warrant preventing her from sailing.
