Man discharged on morphine count

An unemployed man will not have to stand trial on a charge of manufacturing morphine, a class B controlled drug, in his home in Gloucester Street on April 29. David Leslie Mallard, aged 34, had been committed for trial in the High Court, after a preliminary hearing in the District Court, on a joint charge with another man and a woman of manufacturing the drug. . t The other two accused

had pleaded guilty to the offence and were sentenced at appearances in the High Court last month. Mallard’s counsel, Mr W. Rosenberg, yesterday sought a discharge, under provisions of section 347 of the Crimes Act, on the manufacturing charge. This was granted by Mr Justice Holland. The application was not opposed by the Crown, for which Mr G. K. Panckhurst appeard. Prosecution evidence was

that the three accused were found in Mallard’s house when drug squad detectives raided it Equipment used in the manufacture of drugs was found, and 53.9 milligrams of morphine was found in the equipment. Mallard still has to face in the District Court two associated charges — permitting his premises to be used for manufacturing morphine, and possessing a needle and syringe for the Injection of morphine. ■
