$60,000 damages

PA Wellington A High Court jury last evening awarded a former cancer patient, Rosemarie Jayne Duffy, $60,000 damages for wrongful arrest.

After 13 hours deliberation, the jury found that Miss Duffy was not drunk at the time of her arrest.

The jury also awarded Miss Duffy $40,000 general damages in a first alternative claim, in which the jury was asked to assess damages on the assumption that an unlawful detention began after Miss Duffy had been put in a police van.

In a second alternative claim, the jury awarded Miss Duffy $30,000 general damages on the assumption that an unlawful detention began when a man named Henderson had been put in the van.

Mr Justice Eichelbaum has still to determine which

of the alternative claims should apply, and the liability of the defendant, the Attorney-General, sued in respect of the Police Department. After the jury’s verdict was given, his Honour adjourned the proceedings to a date to be fixed.
