Court overturns Motunui decision
PA Wellington Shift work at the $l4OO million Motunui gas to gasoline project will begin on Monday, after a High Court decision yesterday. The Chief Justice, Sir Ronald Davison, yesterday quashed a decision of the Wage Freeze Authority not to approve a plant agreement on annual salaries and service allowances. In a reserved decision delivered in the High Court at Wellington, Sir Ronald ordered the authority to approve the agreement between the Synthetic Fuels Corporation and the Institute of Marine and Power Engineers, before Monday. Sir Ronald said the High Court would not usually usurp the Wage Freeze Authority but the only possible decision - under law was to approve the application.
The authority should have reached the view that the proposed rates of pay were not in excess of those being paid to Petralgas workers. Sir Ronald criticised the authority for not disclosing to the corporation documents it relied on in making a decision. I; It,was.a.breach of natural ■■justice not to give the corporation the chance to comment on them.
