Trespassing appeal
PA Auckland The Ngati-paoa Whenua Committee is appealing to the High Court against the District Court conviction and sentencing of 11 members of the Ngati-paoa tribe who were arrested for
trespassing on Maori Affairs Department land at Waiheke Island in February. The 11 were found guilty of trespassing on the land at a hearing in May. The committee says the
appeal is on the ground that the Board of Maori Affairs failed to comply with a basic requirement of the Maori Affairs Act, 1953. The board, it says, failed to convene a meeting of the board before issuing the trespass notice.
By failing to do so, the committee claims, the trespass warning given by the director of the Maori Affairs Department in Hamilton, Mr Dixon Wright, had no legal authority.
