Vegetable garden sold by mistake
PA Wellington Am elderly widow sold her vegetable garden to a milkman by mistake, the Court of Appeal was told. Mrs Luciza Ozolins, of Palmerston North, arranged to sell “land at the back” of her house, it was said in evidence. The buyer was Bernard John Conlon. A price was decided and an agreement signed. However, on finding that the land legally described in
the agreement included her garden, Mrs Ozolins refused to complete the sale. The case was taken to the High Court, which ruled in favour of Mr Conlon. Mrs Ozolins approached the Court of Appeal, which, in a majority judgment released recently, allowed her appeal against the High Court decision. The Appeal Court referred the case back to the High Court with a direction that it apply the Contractual Mistakes Act, 1977.
