Discharge for husband

PA Invercargill A man charged with raping his wife was discharged when he appeared in the High Court at Invercargill on Wednesday after his wife refused to testify against him.

The man, whose name was suppressed, was discharged by Mr Justice Holland shortly after the trial began.

The man’s wife was the first witness called and when she said she did not want to give evidence, the Crown prosecutor, Mr G. S. Noble, said he had no other evidence to offer. His Honour said that a man could not be convicted for raping his wife unless the pair lived apart, but if they were still husband and wife, a wife could not be compelled to give evidence against her husband.
