Police constable to face disciplinary proceedings
PA Wellington A police constable will face disciplinary proceedings for his relationship with the wife of a man accused of a sexual offence. In a Court of Appeal judgment this week, conviction in the High Court at Wellington of Jules Pierre Nicholas Mikua, aged 25, contractor, on a charge of assaulting a schoolgirl, aged
14, with intent to rape, was quashed. An important part of the Crown evidence was a signed and detailed typed confession by Mikua, taken by a constable at a police station. The Court said that it had been found since the trial that the constable who had taken the statement had become involved in a “very
close” relationship with the accused’s wife. This relationship started after the depositions hearing and existed at the time of the trial. Deputy Police Commissioner M. T. Churches said there had been an inquiry and that the officer would be the subject of disciplinary proceedings under the police regulations.
