‘Notoriety’ debt

PA Whangarei A default summons for $2424 in rate arrears brought against the deceased drugs boss, Alexander Sinclair, by the Bay of Islands County Council, has been heard in the District Court at Kaikohe.

Judgment was entered for the council by Judge Paul which normally would clear the way for the sale of Sinclair’s Okiato Point property, opposite Opua on which the rates are owing, if the arrears are still unpaid in six months. However, the county’s general manager, Mr Maurice Plowright, said yesterday that the situation was complicated by the reported claim by the Inland Revenue Department on

Sinclair’s assets for income taxes. Appearing for the council in court, Ms Sue Wooldridge said there had been notice in the press of Sinclair’s death since the summons was served. The council had twice written to the defendant’s solicitors in London without receiving a reply, and had been unable to ascertain a personal representative of the defendant.

Judge Paul queried whether he was entitled to enter judgement in view of it being a “matter of notoriety” that the defendant was deceased, but Ms Wooldridge submitted that this could be done.

No-one appeared for Sinclair.
