Sir,—D. W. Bird (September 2) overlooks that the convicted rapist served a term of imprisonment. The Deportation Review Tribunal’s obligation is not to impose a further penalty, but to determine whether it would be “unduly harsh or unjust”

to deport the offender and “contrary to the public interest” to allow the offender to remain in New Zealand. Immigration requires regard to the applicant’s age; period resident in New Zealand; personal and domestic circumstances; employment record; nature of the offence and of any previous conviction, and interests of his family. Accordingly, the tribunal must weigh character and circumstances against convictions. I say this without commenting on the merits of the tribunal’s particular conclusion. I note Mr Malcolm’s criticism: another example of Ministerial attack on the courts and tribunals and, in my view, improper, unconstitutional, and contrary to the public interest. — Yours, etc.,
