Man alleges rape

NZPA San Diego A lawyer for a man charged with the manslaughter of a woman said yesterday that the man had reacted out of fear and terror after she raped him and threatened to kill him. The lawyer, Robert Boyce, said that he believed it was the first case in California in which a man had used rape as a ground for self-defence.

The accused, Clifford Stone, aged 25, has admitted bludgeoning Rosemarie McNeil, aged 30, to death with a stone in 1980, but said that he had acted in self-defence.

Mr Boyce told a jury in the San Diego Superior Court that Stone had reacted out of “pure fear” — terror and fear of being killed. He said in his summing up: “Maybe that is bizarre behaviour for a woman. But is it any more bizarre than other behaviour by McNeil?

“You have heard testimony that she was forward, chased men around, and said she could straighten out gay men,” he said.
