After hearing submissions by counsel in chambers, the Judge returned to court and said that the three men would be released on bail, until the depositions hearing at the District Court at Feilding on February 7. Bail was unopposed by the prosecution and in granting it Judge Satvanand said that

each of the accused had ties locally and to the Samoan community throughout NewZealand, with extended family support and supervision available. The police had indicated that they had concluded inquiries into the alleged offence and the remand, until the hearing for the taking of depositions, was a very lengthy one. said the Judge.
