Judge ‘most unsympathetic’
PA Auckland Judge Deobhakta said he was "most unsympathetic” to the prosecution when a convicted heroin importer, Brian James Curtis, appeared before him.
Curtis, who is serving a 16year jail term, appeared in the District Court at Auckland handcuffed to a prison officer and flanked by two others.
He pleased not guilty to a charge that on December 17, 1981. being adjudged bankrupt on November 11, 1981. and having received from the Official Assignee a notice requiring him to make out a statement of his assets, debts, and liabilities, the name, address, and otcupa-
tion of every creditor, securities held by each creditor, and to file the form before December 17, 1981, failed without reasonable cause to do so.
He was remanded to December 16.
Curtis told the Judge that he had been in custody for about 3Vz years. He had about 12 years to go.
Mr Simon Moore, for the Crown, said the maximum penalty for the charge was three months imprisonment. The Judge said he was “most unsympathetic” to this particular prosecution.
Mr Moore said that the prosecution was to enable the Official Assignee to get a statement of Curtis's affairs.
