Review of decision refused
PA Wellington The Mining Act is an ex-clusive-code for the granting of mining licences by the Minister of Mines and the Town and Country Planning Act has no application in the matter, according to a High Court judgment yesterday. The judgment by the Chief Justice, Sir Ronald Davison, refused an application for a review of the decision of the Minister to grant a goldmining licence to Kanieri' Gold Dredging, Ltd, to mine an area of about 929 acres near the Grey Rivers The Planning Tribunal was not empowered to conduct any hearing in the matter, the judgment said. The review was sought by the Kopara Sawmilling Company, Ltd, the Westland Conservation and Development Association, and the West Coast provincial executive of Federated Farmers. The Minister of Mines (Mr Birch) was named as first respondent, Kapieri Dredging as second respondent, and the Planning Tribunal as third respondent. '
