Bid to close Countdown fails
Major grocery companies failed yesterday in a legal bid to force the temporary closing of a new wholesale grocery warehouse in Sydenham. Five big competitors had filed an interim injunction application to close Countdown Wholesale Warehouse until an injunction application from the Christchurch City Council was heard on
December 7, but the High Court decision yesterday from Mr Justice Roper in effect defers the interim application until the city council hearing. The action brought against Fenhall Nominees, Ltd, as landlord, and J. Rattray and Sons. Ltd, as merchant, was heard in chambers. An executive director of Rattrays, Mr J. A. Veitch,
said that it would be business as usual at the Countdown store. His firm was pleased with the Court decision but had not seriously considered that the interim application would succeed. The joint application came from Woolworths (N.Z.), Ltd, City South Supermarket, Wardell-Kincaids. Ltd, Keystore Wholesale Grocery. Ltd and Foodstuffs Christchurch, Ltd.
