Test case for Privy Council?

I’A Wellington The rejection by the Court of Appeal of an assertion that many Western Samoans qualify for New Zealand citizenship has opened the way for the question to be put to the Privy Council in London.

The Court of Appeal ruled against an assertion by a Western Samoan woman that she was a New Zealand citizen because she had been born in Western Samoa while the territory was under New Zealand rule.

The woman’s lawyer, Mr G. H. Rosenberg, said the Court’s decision had been expected because a similar

ruling had been made in 1979.

It was a test case: about 100 similar cases were pending in Wellington. Mr Rosenberg sajd the question had had to be put to the Court of Appeal. That opened the way for leave to appeal to the Privy Council, which has the power to change the ruling. Mr Rosenberg said he hoped to know by May 1 whether the case could be taken to the Privy Council. All cases relating to the citizenship question were due to be called in the District Court at Wellington on May 26.
