Agent Orange action
NZPA New York Despite an Appeals Court setback, a spokesman for Vietnam veterans has said that his group would continue its multi-billion-dollar legal action against five manufacturers of the chemical defoliant Agent Orange. '■> Frank McCarthy, leader of Agent Orange Victims International, said a .ruling by the .second United States Circuit Court of Appeals invited further action against makers of! the chemical defoliant, Which was used during the Vietnam War to clear jungles'; . Mr McCarthy said - his group was preparing an appeal to the United States Supreme Court and probably would ' ask Congress for some legislation to help the
veterans. He said -. ' the group’s class-action suit, filed bn behalf of 2.4 million veterans and their families, also may be amended to name the Veterans Administration, the Government body that cares for returned servicemen. The court, in a 2-1 ruling this week dismissed the group’s suit, which claimed the . chemical could cause cancer and birth defects. The court said that the veterans could not sue in a consolidated case but would have to take individual action in home-state courts.
