Lawyer on charge of uttering

PA Auckland A solicitor charged with uttering has elected trial by jury. Appearing in the District Court at Auckland before Judge Mitchell was John Malcolm Murfitt, aged 37, of Takapuna. He was charged that knowing a memorandum of mortgage dated December 19, 1975, between Brian Keith Smith and Rachael Smith as mortgagors and John Murfitt Nominees, Ltd, as mortgagee, to be forged, namely by purporting to be signed bv Bryan Keith Smith and Rachael Smith, he acted upon it as though it were genuine on or about March 25. The Judge remanded Murfitt to July 28 for a depositions hearing. Bail was allowed on his own bond of $lOOO and a similar surety. The Judge also ordered that Murfitt surrender his passport to the court.
