No fourth trial
PA Rotorua i Two Rotorua men, Joseph Charles Smith and George Moana, who have stood trial three times on charges of rape, will not face a Supreme Court trial a fourth time. A stay of proceedings has been ordered by the Solici-tor-General (Mr R. C. Savage, Q-C.) to whom the papers were sent after the third trial in the Supreme Court at Rotorua last month. Smith, aged 30, and Moana, aged 37, were committed for trial in the Supreme Court after a depositions hearing on charges of rape and aiding and abetting
leach other in the offence of rape at Rotorua on April 22, s At the first trial before I the Chief Justice (Sir Ronald : Davison) in July, 1978, they • were found guilty, and were i later sentenced to seven years’ jail. I ; i The case then went to the ■ ■'Court of Appeal and as a re- ■ suit of that hearing it was > sent back to the Supreme ■ Court for retrial, on a point ; arising from the trial judge’s . direction to the jury. i At the two trials which -.followed in May, 1979. and -(last month, the juries failed - to agree on a verdict and f'new trials were ordered in ;'eacb case. ’
