Jail for theft

Because a man had failed to pay restitution of more than $l2OO defrauded from the Social Welfare Department and he had no money it was pointless to give him a community-based sentence and order him to make restitution on a charge of theft as a servant, Mr Justice Somers said in the Supreme Court.

His Honour jailed David Eder, aged 33, an assistant storeman, for nine months on a charge of theft as a servant of Axminster carpet valued at $1496. the property of Flooring Distributors, Ltd. Eder had pleaded guilty in the Magistrate’s Court after the taking of depositions and had been committed to the Supreme Court for sentence.

Mr L. M. O’Reilly for Eder, said that by pleading guilty the prisoner had faced up to his criminal behaviour. Eder acknowledged that he had seen an opportunity to get easy money and had succumbed to the temptation.
