Writ against bank
PA Hamilton The Bank Officers* Union has had a Supreme Court writ served on the A.N.Z. Bank in its dispute about increased mortgage rates for staff. The writ—which asks the Court to declare that the bank has no right to adjust the rates of existing mortgages in terms of its contract with staff — was served on the bank on Tuesday.
The Industrial Court reserved its decision on Wednesday in its separate industrial hearing of the dispute, which last month closed A.N.Z. Bank branches and resulted in 500 staff being suspended for refusing to carry out internal work. The union’s assistant secretary (Mr K. Bunker) said from Wellington yesterday that the Industrial Court hearing had been complicated by a recent Court of Appeal decision which limits
the use of dispute provisions in the Industrial Relations Act. “The recent decision tends to limit the way in which unions and employers can deal with disputes,” Mr Bunker said. The union wants the Industrial Court to establish that “dispute of right” exists. It will then ask the Court to state its case to the Court of Appeal with a view to having the previous deci-* sion reviewed.
