Benning to appeal
PA Wellington Alfred Benning, aged 65, retired clerk, will appear to the Court of Appeal against his conviction on a charge of the murder of his wife, .Elizabeth Benning, at their home in Karori Street, Wellington about September 11. He strangled her and then dismembered the body into six pieces, wrapped them in newspaper, and buried them in the back garden.
His counsel, Mr M. A. Bungay, told reporters that his client would appeal against the conviction on the ground of misdirection of the jury. One of the grounds would be Mr Justice O’Regan’s ruling concerning provocation.
