JBL men’s application

PA Auckland Mr Justice Somers yesterday heard applications for discharge without conviction by several of the former JBL directors and executives found guilty of at least one charge of conspiracy to defraud. He reserved his decision, after hearing the applications in chambers in the Supreme Court at Auckland. The defendants will be sentenced on Monday. His Honour also reserved decision on an application for costs by Hugo Stephen Fanning, the only one of the nine defendants to be acouitted of all charges.

The applications are being heard under section 347 of the Crimes Act, 1961. A subsection states that the judge may in his discretion at any stage of any trial, whether before or after verdict, direct , that the accused be disI charged.
