Council wins appeal

(N.Z. Press Association) WELLINGTON, August 21. The Industrial Court today allowed an appeal by the Invercargill City Corporation over the employing of two female bus cleaners on contract.

Bus-drivers in Wellington and Invercargill stopped I work earlier this year, claiming that the two cleaners should be union members. The Tramways Union had claimed that because a master and servant relationship existed between the corporation and two cleaners, they should be union members. The corporation engaged the two women by tender. The appeal was heard by the court on August 5. In a written decision today. Judge R. D. Jamieson ruled that until there was a contract that created a relationship of master and servant, the award had no application. “If that relationship came into being, then the question whether the workers were piece workers or part-time or casual workers would be pertinent. “Till that point is reached, such a question cannot arise,” he said.
