Retrial for Woolnough

(,V Z. Pres x As sociation) AUCKLAND, Aug. 21. A jury in the Supreme Court at Auckland could not agree tonight 6n a verdict in the trial of James Woolnough on 12 charges of unlawfully using a suction curette to procure a miscarriage. The jury had retired to consider its verdict at 2.55 n.m. It returned just after 8 p.m., and its foreman told Mr Justice Speight that members were not able to agree on a verdict and that there was no prospect of an agreement. Mr Speight ordered a new trial and discharged the jury. He said Woolnough would be retried at a date to be fixed.

Later Woolnough was allowed bail, until the retrial. His Honour told the jury it was vital that matters of public importance should be put to members of the community. Although he was sorry that no decision — one way or the other — had been reached the jury had conscientiously applied itself to its duty. Dr R. Hunton, of the Auckland Medical Aid Centre, Remuera, said after the trial that Woolnough would remain in Auckland until his retrial. Woolnough stood impassively in the dock when the jury announced its inability to reach a verdict.
