Change of S.M.

(N.Z. Press Association) WELLINGTON, July 5. A different Magistrate will be appointed to hear evidence against two young men who were involved in the Woburn “squatting” incident.

Denis Christopher O’Reilly, aged 21, a community worker, and Mark Crichton Derby, 17, a student, today elected this course when they

appeared before Mr J. K. Patterson, S.M., in the Lower Hutt Magistrate’s Court. Observations made on television and comments in newspapers and on radio since the incident prompted the Magistrate to offer two other ways in which the evidence, could be taken. Supreme Court trial could be chosen, or the case could be remanded to enable the appointment of another ; Magistrate who had not had access to comments which ' might be held to be , prejudicial. Both defendants had been charged on June 18 with being found without lawful excuse, but in circumstances which did not disclose the commission of or intention to copimit any other offence, in a Woburn flat, and with resisting arrest. O’Reilly and Derby pleaded not guilty to both charges, and today the police laid a further charge of wilfully trespassing and refusing to leave after a warning. They pleaded not guilty to this charge, and will appear on all three informations on July 12. Bail was continued.
