Nature of charge
The 81 persons arrested at North Linwood on Sunday evening were charged with unlawful assembly under section 86 of the Crimes Act (1961). Under the section, offenders are liable to not more than a year’s imprisonment. Had the arrests been made after midnight on Monday the motor-cyclists might have been charged under an amendment to the act, which came into force on Tuesday. Under the amendment, an unlawful assembly is a group of three or more persons who assemble in such a manner or behave in such a manner as to cause neighbours to fear violence or damage to property, or to provoke other persons to use violence against persons or property in the neighbourhood.
The motor-cyclists were charged under the old section which defined an unlawful assembly as a group of three or more persons who disturbed the peace “tumultuously,” or caused neighbours to fear a disturbance, or provoked other persons to disturb the peace “tumultuosly.”
