Acquittal on site death

(N.Z. Press Association) WELLINGTON, March 7. A charge laid against Cubitts (New Zealand) Ltd, and three employees, alleging that they left an excavation unfenced in central Wellington on June 29 last year, was dismissed in the Magistrate’s Court, Wellington yesterday. The charge was related to others against the employees, alleging manslaughter and criminal nuisance by an ommission in their duty, and a charge of criminal nuisance which had been laid against the company. These charges, on which al! parties were acquitted in the Supreme Court last month, arose from the death of Graeme Anthony Van Dorp, aged 3, when he fell from the footpath on to steel reinforcing at the building site, in Bunny Street. For the prosecution, Mr K. G. Stone asked for leave to withdraw the present charge, to which all had pleaded not guilty. __
