Trainer out for 2 years
An amateur trainer has been fined $5OO and disqualified for two years after being found guilty on three charges of corraptj>ractlce within the Rules of He S Anthony Milina, of Helensville, and the charges result from the racing of the pacer, Farex Boy, which won three times and was placed on 10 occasions last season. James Darby Delany, of Auckland, was also found guilty on identical charges and fined $250 and disqualified for one year. The inquiry, which was heard before Messrs Lloyd Brown, E. J. V. Dyson and R. J. Rolfe, concerned the ownership and racing of Farex Boy and It was proved that false declarations In respect of the ownership of the horse were made. Farex Boy was not disqualified from any races as a result of the inquiry. Mr Charles Dudley, the chief racecourse inspector, prosecuted for the Trotting Conference. He produced evidence that showed that in 1965 Farex Boy was owned by G. A. Barry but two years later Delany gained a half-share in the horse and this was registered. was glven by Delany that Milina approached the partners and expressed interest in acquiring Barn’s half share. Apparently there was antagon’sm kt that time between Barry find Delany, and Barry Indicated that he would sell his share in the horse only if Delany did also.
A plan was conceived between Delany and Milina that would mislead Barry into thinking MiUna was acquiring ownership from both partners but that a P ei l od three months MUina would transfer ownership of the horse back to Delany and take from him a lease. Delany provided Milina with $7OO to buy Barry’s half share, according to the evidence. The committee hearing the inquiry’ accepted this evidence and rejected Milina’s version. “That Milina should endeavour to set up such a situation is not surprising in view of his later actions in selling Farex Boy for $7500 and going to considerable lengths to conceal from Delany the selling price by requiring payment in two cheques of $3OOO and $4500 in order to effect the deceit,” commented the committee.
Delany admitted the breaches and the committee said it took his frankness into consideration when considering the penalties.
