Magistrate’s Court YOUTH ADMITS STREET STABBING
A youth who stabbed another person in the back in Colombo Street pleaded guilty in the Magistrate’s Court yesterday to charges of assault with Intent to injure and having an offensive weapon. He was Alan Kenneth Twyman, aged 18, an apprentice electrician. Mr H. J. Evans, S.M., convicted and remanded him on bail until June 17. The Magistrate ordered the defendant to keep away from the complainant and the girl who was with him.
Sergeant R. S. Morgan said that the complainant and the girl were walking along Colombo Street at 8.50 p.m. on June 4 when Twyman ran across the road with a sheath knife in his hand, knocked the complainant to the ground, and stabbed him in the back. The blade penetrated his coat and made a 4in scratch on the skin.
When the complainant got up the defendant was about lOft away, waving the knife at him, said Sergeant Morgan. No medical attention was required by the complainant. The defendant then ran off, and reported the incident to the police at 9.30 p.xn. He said that when he saw the complainant with his (the defendant’s) girl-friend he knew he wanted to stab him. ESCAPE FROM CUSTODY Easter Keripehi Waenga, aged 20, unemployed, was sentenced to two months imprisonment when he pleaded guilty to escaping from the lawful custody of the superintendent of the Christchurch Prison.
Sergeant Morgan said that the defendant was sentenced to a year’s Imprisonment on September 10. 1970, for burglary. On April 5 he was granted prerelease and allowed to work in outside employment, returning to the prison at 6 p.m. On June 2 he failed to return. He gave himself up three days later. He said that he got drunk and later went to Invercargill. He returned because his money ran out.
"You tried to beat the gun by nine days and you cannot expect to get away with this for nothing,” said the Magistrate.
EXCESSIVE ALCOHOL Phillip Stanley Freeman, aged 26, an Army sergeant, was fined 5200, disqualified from driving for one year and a half, and ordered to pay medical expenses of 610.50 when he pleaded guilty to a charge of driving with an excessive alcohol concentraUon. Sergeant Morgan said that the charge resulted from a collision at the Junction of Riccarton Road and Hansons Lsne at 1.15 p.m. on April 25. A test showed a concentration of 240 milligrams of alcohol to 100 millilitres of blood.
The defendant had spent a considerable time overseas and served his country well, said Sergeant Morgan.
THREE MEN FINED Three men who appeared for sentence on a charge of stealing 44 gallons ot petrol and a battery worth $35.50 on May 20 were each fined $lOO and placed on probation for 18 months. They were Norman Barry Johnstone,
aged 25, a labourer (Mr M. A. Burns), Desmond Peter Sheehan, aged 20, a storeman (Mr L. M. O’Reilly), and John William King, aged 24. a contractor (Mr R. F. B. Perry’). The Magistrate said that the theft was deliberate, but clumsy. It was not surprising that the defendants were caught. Each had a bad record of offending.
TRESPASS Charles William Tuhou, aged 29, an unemployed cleaner, was remanded in custody until June 11 when he pleaded guilty to a charge of wilful trespass on June 9.
Sergeant V. F. Townshend said that the‘defendant and the complainant were involved in an argument and the complainant went home. She went into the living room later and found the defendant there. He said he had come to talk to her. He refused to leave and the police were called. He still refused to leave, saying he had nowhere to sleep.
BURGLARY Colin Andrew McKay, aged 19, an apprentice panel-beater (Mr D. H. Hicks), was fined $lOO and released on probation for one year when he appeared for sentence on a charge of burglary. Conditions of probation are that he does not associate with persons not approved of and opens a savings account into which he pays not less than $lO a week. Restitution of $45 was also ordered to be paid. Mr Hicks said that the offence was instigated by another person who was wanted by the police. The defendant was living with this person when the offence was committed. He was behind in his payment of rent and stole radios to get funds. The defendant did not have any share of the proceeds. The Magistrate noted that the defendant was released on probation one month ago for receiving. CAR UNLAWFULLY TAKEN Robert Anthony Duff ell, aged 21, a labourer (Mr E. T. Higgins), was fined $l5 and ordered to pay witnesses* expenses of $4 when he was convicted of unlawfully taking a car valued at $3OO. He pleaded not guilty. Brian George McAllister said that his car was parked in Cashel Street while ne was in the defendant’s house. He gave the defendant the keys to the car so that he could get beer from the boot. The defendant drove off in the car, but not very fast, as he was not very sober. He returned after half an hour. The witness said he later noticed that some things were missing from the boot and reported the incident to the police. Cross-examined, the witness said that the defendant had driven his car on other occasions. He did not get in touch with the police on the date of the offence because he thought he might be charged for letting the defendant drive without a licence. The Magistrate said that the defendant nad no real belief that he had permission to take the car. THEFT OF $l6O
Ronald Leslie Coulter, aged 28, a prison inmate, pleaded guilty to a charge of stealing $l6O from his employer, Autocrat Radio, Ltd. New Brighton, on December 1. He was convicted and ordered to pay $l6O restitution. Sergeant Townshend said that the charge was similar to eight charges arising from offences committed at the same period last year. The defendant had been sentenced to six months imprisonment on the other charges on March IS.
On November 30 Coulter called at an Aranul auction firm as part of his business. Sergeant Townshend said. The auction firm required three used television sets. When their reKresentatives went to Autocrat adio, Ltd, Cbulter permitted them to take three sets and asked that a cheque for $l6O be made payable to him. The cheque should have been made payable to Autocrat Radio, Ltd.
ASSAULT BY WOMAN A hotel manager who remonstrated with a young woman after she flicked a lighted cigarette on to the hotel carpet was kicked in the groin by the woman. Sergeant Townshend said when Judith Myra Crothall, aged 22, unemployed, appeared on a charge of assaulting Cyril Charles Newsome, on May 22. She pleaded guilty and was convicted and released on probation for 12 months.
In explanation Crothall told the police she kicked the comlainant because he was a liar, said Sergeant Townshend. She had been drinking.
FICTITIOUS CALL Alfred John Oldham aged 23, a metal polisher, pleaded guilty to a charge of giving a fictitious message over a telephone on April 6. He was convicted and fined $5O and ordered to pay restitution of $2O.
Sergeant Townshend said that the fire brigade received a telephone call to attend a fire in a house at Papanui. There was no fire. The defendant, when interviewed by the police, said that he made the call to embarrass the occupier of a house. He said he had been drinking heavily all day. THEFT OF BICYCLE Elaine Wilma Hunia, aged 21. unemployed, was convicted and ordered to pay costs when she pleaded guilty to a charge of stealing a bicycle on June 8. Sergeant Townshend said that a constable saw Hunia take a bicycle from the road outside the Chief Post Office. She wheeled It on to the Godley Plot, where she removed clothing from a carrier. When questioned Hunia said that a friend had given the bicycle to her. She was then arrested. She was intoxicated. FOUND IN YARD On a charge of being found in an enclosed yard. Terrence Widdowson, aged 23, a fitter and turner was discharged without conviction, but ordered to pay costs. He pleaded guilty. Sergeant Townshend said that Widdowson was seen trying to enter a locked car at 12.15 a.m. on May 5 in an enclosed yard. He was then seen crouched alongside the car. When arrested, Widdowson was lying under a trailer. He said he had been drinking and wanted to get some sleep. DISCHARGED Patrick Tui Walker, aged 21. a cable joiner, was discharged without conviction on charges of unlawfully interfering with a car and being found In a building. He pleaded guilty to the former charge on Tuesday, and guilty to the latter charge yesterday. He was ordered to pay costs and $lO restitution. OBSCENE LANGUAGE Michael Kenneth Borrell, aged 18, a labourer, was fined $lO for using obscene language in Cathedral Square on June 8. He pleaded guilty. OFFENSIVE WEAPON Stephen John Mead, aged 19, a deckhand on the m.v. Canopic (Mr A. S. Forbes), was convicted and ordered to pay costs on a charge of carrying an offensive weapon, a dagger, in a public place. He pleaded guilty. MISCELLANEOUS CASES In miscellaneous police prosecutions convictions were entered and fines imposed as follows, with costs of $5 in each case:—-

Person under 20 found in possession of liquor in public bar: Anthony John EUmers, $lO. Person under 20 purchased liquor in public bar: Roger Joseph Cumming, $10; Ivan Popich, $lO. (Before Messrs W. RECEIVING CHARGE A woman, whose name was suppressed, was committed for trial on a charge of receiving $91.25 from her son-in-law on or about April 10. knowing it had been dishonestly obtained. She was represented by Mr M. A. Burns.
Sergeant J. A. McPhee said that about $4600 was stolen from a strongroom at the offices of Burke’s Caterers, Ltd. during the Easter week-end, ano the police received information that the defendant had some of the money. Detective Constable James Victor Dwight said that he and two other detectives searched the defendant’s home. The defendant was not at home but her husband, a daughter, and son-in-law were there.
Eight dollars worth of 1c coins was found In a plastic bag hidden in the defendant’s bed. Another $2O worth of coins was found in two jars in a suitcase under the bed. At this stage the defendant’s son-in-law was arrested for the burglary. Detective Sergeant William Rae Withers, one of the other detectives, said he found a newspaper clipping on a mantelpiece which gave details of the burglary. After the defendant had been interviewed coins amounting to $7 were found in a plastic bag in her car and another plastic bag full of 20c coins was found in her handbag. She admitted that the money had been given to her by her son-in4aw and that he had told her it was part of the proceeds of the Burke’s burglary. (Before Mr W. F. Brown, S.M.)
TWO OFFENCES Dennis Keith Watson, aged 27, appeared for sentence on charges of theft and carrying a loaded firearm in a motorvehicle. On the theft charge, which involved the shooting of two geeese worth $8 at Hurunul, he was discharged on condition that he pays $2O towards the cost of S rosecution and $2.25 restitution. n the other charge he was ordered to pay costs. A warrant for the arrest of Barton Robert Williams, aged 32, a labourer, was issued when he failed to appear on charges of driving with an excessive alcohol concentration, failing to comf>ly with road markings, and fating to keep to the left.
