WINE SHOP APPEAL
Adjournment granted An appeal by Mr H. M. Meyers against a decision by the Canterbury Licensing Committee, granting Mr J. T. Turner a wine reseller’s licence at Fendalton was adjourned by the Licensing Control Commission yesterday. Mr R. G. McElrea, who appeared for Mr Turner, said that the premises to which the wine reseller’s licence would apply would be in a supermarket at 19-23 Memorial Avenue which had been erected by Mr Turner. The history of this supermarket went back to the granting by the Waimairi County Council of a specified town-planning departure, its subsequent endorsement by the Town and Country Planning Appeal Board and proceedings in the Supreme Court which set aside the appeal board decision. “In the meantime, the premises are nine parts erected,” said Mr McElrea. “Mr Turner has applied to the Court of Appeal to have the Supreme Court decision set aside, and the Court of Appeal is now hearing this case. Counsel are likely to be engaged all day today. In the circumstances, the appeal to the commission should be adjourned to await the Court of Appeal decision.” Mr P. G. S. Penlington, for Mr Meyers, raised no objections and the adjournment was granted.
