Decision reserved on Turner appeal

WELLINGTON, November 18.
The Court of Appeal yesterday afternoon reserved its decision on an appeal by the W. J. Turner family against a Supreme Court writ of certiorari against the Town and Country Planning Appeal Board, in respect of a proposed mall and supermarket at the corner of Fendalton Road and Memorial Avenue.
The Court had been told that proceeding witl, the building of a supermarket, even after service of a writ restraining such action was taking a “foolhardy chance.” Mr J. G. Leggat, continuing his submissions for the respondents (Lester Frederick Allison and John Charles Marshall, and the three members of the appeal board) said that the court should not interfere with a Supreme Court decision unless “clearly satisfied that it was wrong in law.” Mr Erber concluded the respondents’ submissions by stating that the board had unlawfulliy delegated its deci-sion-making power to a Christchurch town-planning
consultant, Miss Nancy Northcrqft, by giving her unfettered power to resolve the landscaping dispute affecting the supermarket.
